How to verify a citation before you file

A short checklist to make sure every authority in your pleading is real, current and on point — before it reaches a judge.

Before any citation goes into a filing, run it through this checklist.

The checklist

  1. Does the judgment exist? Open it. A real citation resolves to a retrievable judgment with parties, court and date.
  2. Is it good law? Check for negative treatment — overruled, distinguished or doubted.
  3. Does the ratio apply? Confirm the holding actually supports your proposition on the facts.
  4. Is the statute current? If you rely on a section, confirm it is in force, with amendments traced.
  5. Is the neutral citation correct? Match the citation format the court expects.
